Public Act 102-0662 (the “Climate and Equitable Jobs Act”) was signed into law and became effective September 15, 2021. The legislation calls for the procurement of Carbon Mitigation Credits (“CMCs”) from Carbon-free Energy Resources in an amount of no more than approximately 54,500,000 CMCs annually for ComEd beginning with the delivery year commencing on June 1, 2022. A “Carbon-free Energy Resource” means a generating unit that is fueled by nuclear power and is interconnected to PJM. This procurement event is held through the Carbon Mitigation Credits RFP or “CMC RFP”.
The Procurement Administrator has posted the following documents:
- The schedule is posted to the Calendar page of the procurement website.
- The draft RFP documents, including the draft RFP Rules, draft Proposal Form (Appendix 2), and draft Bid Form (Appendix 3) are posted to the Draft Documents page of the Carbon Mitigation Credits section of the website.
- The final version of the Standard Pre-Bid Letter of Credit for ComEd (Appendix 4) and the Confidentiality Statement (Appendix 5) are posted to the Final Materials page of the Carbon Mitigation Credits section of the website.
Bidders may provide comments on or propose modifications to the Standard Pre-Bid Letter of Credit for ComEd by the opening of the Proposal Window on Friday, November 12, 2021. Comments and requests for modifications must be made by submitting a redline of the Pre-Bid Letter of Credit in Microsoft Word format to the Procurement Administrator at Illinois-RFP@nera.com. A preliminary list of modifications that are already acceptable to ComEd is available on the Final Materials page of the Carbon Mitigation Credits section of the website. All Bidders may use modifications on this list on an optional basis. Any one of a Bidder’s comments or proposed modifications to the Standard Pre-Bid Letter of Credit approved in this Fall 2021 CMC RFP may result in an addition to the list of modifications.
