2022 Coal to Solar Procurements (AIC and ComEd)

Public Act 102-0662 (the “Climate and Equitable Jobs Act”) was signed into law and became effective on September 15, 2021. The IPA Act, as amended by Public Act 102-0662, established two procurement events for renewable energy credits from new renewable energy facilities that are installed at or adjacent to sites of electric generating facilities that burn or burned coal as their primary fuel source and that meet eligibility criteria specified in Section 1-75(c-5) of the Act.

Q: Is the Seller required to own the Coal Facility?

Under the C2S Procurement, the “Seller”, which is the entity that delivers RECs from a Project under the term of the applicable supplier contract for this C2S Procurement and is signatory to the applicable supplier contract must be either the “Owner”, which is the entity that owns the Coal Facility, or an affiliated entity of the Owner.

Q: Are Projects required to be installed at sites of current or former electric generating facilities that burn or burned coal as their primary fuel source?

In accordance with the IPA Act, projects must be installed at sites of current or former electric generating facilities that burn or burned coal as their primary fuel source and that meet all eligibility criteria specified in Section 1-75(c-5) of the IPA Act. Projects may be installed on property adjacent to such sites if necessary for sufficient space.

Q: Can you provide an estimate of the Supplier Fee ($/REC) and instructions for payment to the IPA?

Proponents and Sellers are required to pay the Supplier Fee to the Illinois Power Agency (“IPA”) for a Project that has been selected through the C2S Procurement and approved by the Commission no later than seven (7) business days after ICC approval of the results of the procurement event.  An estimate of the Supplier Fee is $1.00 times the annual quantity of RECs selected for a Project.  The final amount of the Supplier Fee (in $/REC) and instructions regarding payment of the Supplier Fee will be provided no later than 6 PM CPT on Monday, April 25, 2022.

Q: Can you confirm proposal assurance of collateral in the form of cash or of a letter of credit to each of the Companies is due by the Proposal Due Date?

All materials for the Proposal, including proposal assurance collateral in the form of cash or of a letter of credit to each of the Companies, must be received by 12 PM (noon) CPT on April 13, 2022, the Proposal Due Date.

Q: Is submission of an Expression of Interest form a requirement to participate in the Coal to Solar and Energy Storage Initiative Procurement Events?

Submission of an Expression of Interest form by the January 5, 2022 deadline is not a requirement to participate in the Coal to Solar and Energy Storage Initiative Procurement Events (C2S Procurement). Please see the Coal to Solar Procurement Rules and Appendices posted to the Final Materials page of the Coal to Solar section on the procurement website for a complete description of the requirements to participate in the C2S Procurement.

Q: Are the procurement events held under Coal to Solar for solar projects located on or adjacent to coal fueled electric generating facilities only or are solar projects located on or adjacent to coal mines also eligible?

The procurement events held under Coal to Solar will seek to procure renewable energy credits (“RECs”) from new renewable energy facilities that are installed at or adjacent to sites of electric generating facilities that burn or burned coal as their primary fuel source and that meet eligibility criteria specified in Section 1-75(c-5) of the Act.

The Indexed REC RFP will seek to procure RECs from new utility-scale wind Projects (Projects over 5 MW), new utility-scale solar Projects (Projects over 5 MW), and new brownfield site photovoltaic Projects. Under the Indexed REC RFP, the definition of a brownfield site photovoltaic project includes photovoltaics that are “located at the site of a coal mine that has permanently ceased coal production, permanently halted any re-mining operations, and is no longer accepting any coal combustion residues; has both completed all clean-up and remediation obligations under the federal Surface Mining and Reclamation Act of 1977 and all applicable Illinois rules and any other clean-up, remediation, or ongoing monitoring to safeguard the health and well-being of the people of the State of Illinois, as well as demonstrated compliance with all applicable federal and State environmental rules and regulations, including, but not limited, to 35 Ill. Adm. Code Part 845 and any rules for historic fill of coal combustion residuals, including any rules finalized in Subdocket A of Illinois Pollution Control Board docket R2020-019”.

On January 24, 2022 the Procurement Administrator posted an Invitation to Comment on the Draft Indexed REC RFP Rules, which includes requirements related to qualifying a project site located on a permanently closed coal mine. Please note that the definition of a brownfield site photovoltaic project also includes photovoltaics that are interconnected to an electric utility, a municipal utility, a public utility, or an electric cooperative as defined by the Act, and located at a site that is regulated by the United States Environmental Protection Agency (“US EPA”) under either the federal Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended, or the Corrective Action Program of the federal Resource Conservation and Recovery Act, as amended; or by the Illinois Environmental Protection Agency under either the Illinois Site Remediation Program, or the Illinois Solid Waste Program.
