SPV-106: Can the IPA claim Force Majeure and terminate the SPV Contract with a Seller if the IPA is able to purchase cheaper RECs elsewhere?

No. As stated in Article 15.2, a Force Majeure Event cannot be based on the IPA’s ability to purchase RECs at a price below the Purchase Price.

← Under the SPV Contract, it is an Event of Default if the Seller fails to Deliver any REC from the System for a consecutive period of six months. Can the Seller request an extension of this six month period if there are valid reasons for the Seller to have failed to Deliver during that period? Can we submit a single “sample” contract and then provide individual signature pages for each contract we have in place to demonstrate the agreement between the System Owner and Seller? →
