Under Public Act 099-0906 (“Act”), a utility-scale solar project meets the definition of “new photovoltaic projects” if it is energized after June 1, 2017. This definition does not specify a “no later than” date. The Act defines “new wind projects” as wind renewable energy facilities that are energized after June 1, 2017 for the delivery year commencing June 1, 2017 or within 3 years after the date the Commission approves contracts for subsequent delivery years.
