The “Companies” are Ameren Illinois Company d/b/a Ameren Illinois (“AIC”), Commonwealth Edison Company (“ComEd”), and MidAmerican Energy Company (“MEC”).
The Pre-Bid Letter of Credit for a Company must be in the form of the Standard Pre-Bid Letter of Credit (provided as Appendices 10, 11, 12 and 13 to RFP Rules) or incorporate only those modifications approved by the applicable company and posted Standard Products Section of the procurement website (under the applicable Pre-Bid Letter of Credit). A Bidder may, in its Part 1 Proposal, propose modifications to the standard form of the Pre-Bid Letter of Credit for AIC Capacity Products.
There is no pre-approval process forthe Pre-Bid Letters of Credit prior to issuance by the bank. The Pre-Bid Letters of Credit for procurement events for Energy Products are due by 12 PM (noon) on the Part 2 Date of September 7, 2016; the Pre-Bid Letter of Credit for the procurement event for Capacity Products is due by 12 PM (noon) three (3) days prior to the Bid Date for Capacity Products, on September 13, 2016. When the Pre-Bid Letter of Credit is issued for a procurement event, the Company receives, reviews, and evaluates the Pre-Bid Letter of Credit for that procurement event. If a Pre-Bid Letter of Credit is deficient (because the Pre-Bid Letter of Credit is not in the standard form or incorporates modifications not approved by the applicable Company), the Bidder must provide an amendment to the Pre-Bid Letter of Credit. In general, a bidder will have two (2) days from receipt of a first notification of a deficient Pre-Bid Letter of Credit to respond with an amendment. In no event will the deadline to respond to a deficiency notice be after 12 PM (noon) on the Bid Date.
